Bonus can be claimed even after leaving the job

by Khushi Mehta last modified Nov 13, 2010 01:08 PM

An employee who is eligible to receive bonus according to the Payment of Bonus Act, 1965 can claim the same for the period equivalent to what he has worked for, even after leaving the job. Such bonus, which is due and unpaid, can be claimed by the employee within one year of its becoming due and the employer is liable to pay the same.

However, no such liability incurs on employer when an employee has been dismissed from service for fraud, riotous or violent behavior, or theft, misappropriation or sabotage of any property of the establishment. The employer even has a right to forfeit bonus of such an employee.
